The General Terms and Conditions governing registration, roles and responsibilities, and use of the UNNATI Portal by every Training Institution, Subject Matter Expert, and other User.

Introduction

1.1

Background: India’s civil servants function as the primary interface between the State and its citizens, and the capability of this civil service is central to effective governance and public service delivery. Mission Karmayogi represents the Government of India’s flagship programme for building a future-ready, citizen-centric civil service through continuous, competency-based capacity building.

While iGOT Karmayogi addresses digital, self-paced learning, a substantial part of civil service capacity building continues to be delivered in person, through Training Institutions (“TIs”) situated across the country. Such institute-based training draws on infrastructure, faculty, and course content that can often be geographically limited, unevenly distributed, and constrained by the resources available to any single TI in isolation. UNNATI has been developed by the Capacity Building Commission (“CBC”) as a Portal to address this constraint and enable TIs to discover and draw upon each other’s infrastructure, faculty, and course content. Further, the Portal also facilitates access to a curated pool of Subject Matter Experts (“SMEs”) who may be leveraged, directly by TIs or through engagements formally constituted by CBC, to strengthen the quality and relevance of institute-based training. The Portal is poised to evolve and include further functionalities geared towards assessing and enhancing capability in training institutes and expanding opportunities for capacity building by leveraging digital interoperability and emerging technology.

1.2

Objective: The objective of this document is to set out, in a manner binding on CBC, every TI, and every SME accessing the Portal, the terms governing registration, roles and responsibilities, permissible and prohibited conduct on the Portal, and the consequences of non-compliance, while preserving the institutional autonomy of TIs and the professional autonomy of SMEs in respect of arrangements they enter into with each other, which shall remain theirs to determine and shall not require the involvement of CBC, except where expressly stated otherwise in this T&C.

1.3

Status of this Document: This document shall constitute the General Terms and Conditions (“T&C”) governing the UNNATI Portal, and shall act as a legally binding instrument between CBC, on the one part, and each TI, SME, and other User of the Portal, on the other. This T&C shall be read together with such Special Terms and Conditions, Engagement-Specific ToRs, and Portal policies as CBC may issue from time to time, which shall supplement, but shall not derogate from, this T&C except to the extent CBC expressly provides otherwise.

Definitions

For the purposes of this T&C, unless the context otherwise requires:

  • “Portal” or “UNNATI” shall mean the Unified New-Age National Training Initiatives platform administered by CBC through which TIs and SMEs and other Users are registered, enrolled, and enabled to participate in the activities described in this T&C.
  • “CBC” shall mean the Capacity Building Commission.
  • “TI” shall mean a Training Institution registered, or seeking registration, on the Portal.
  • “SME” shall mean a Subject Matter Expert enrolled, or seeking enrolment, in the SME Pool.
  • “User” shall mean any TI, SME, or other person or entity accessing or using the Portal in any capacity.
  • “MDO” shall mean a Ministry, Department, or Organisation of the Central Government, and shall be read to include the corresponding State/UT authority where the context so requires.
  • “CBP” shall mean Capacity Building Plans.
  • “KCM” shall mean the Karmayogi Competency Model.
  • “SME Pool” shall mean the directory of enrolled Subject Matter Experts maintained by CBC on the Portal, made discoverable to TIs and available for engagement in accordance with Section 7 of this T&C.
  • “Resource-Sharing Ecosystem” shall mean, collectively, the Infrastructure Sharing Pool, the Faculty Sharing Pool, and the Course Content Library maintained on the Portal, through which TIs may offer, discover, and avail infrastructure, faculty, and course content shared by other TIs.
  • “Portal Content” shall mean any course, module, curriculum, or training material uploaded, listed, or shared by a TI on the Course Content Library, whether created solely or jointly.
  • “CBC Engagement” shall mean any existing or projected initiative formally constituted by CBC involving the participation of one or more SMEs, including, without limitation, institute-based training course development or updation, governed by an Engagement-Specific ToR issued by CBC at the relevant time.
  • “Engagement-Specific ToR” shall mean the terms of reference issued by CBC governing a particular CBC Engagement, as referred to in Section 7 of this T&C.
  • “Competent Authority” shall mean the officer or authority within CBC designated to exercise a particular function under this T&C.
  • “DPDP Act” shall mean the Digital Personal Data Protection Act, 2023.
  • “Digital Trinity” shall mean the architecture comprising iGOT Karmayogi, UNNATI, and HRMS/eHRMS. This T&C shall govern UNNATI alone and shall not be read to extend any party’s obligations in respect of iGOT Karmayogi or HRMS/eHRMS, which shall be governed by separate instruments.

Applicability and Acceptance

3.1

This T&C shall apply to CBC, every TI registered or seeking registration on the Portal, every SME enrolled or seeking enrolment in the SME Pool, and every other User.

3.2

Access to or use of the Portal in any capacity and through any mode, including but not limited to registration, enrolment, login, submission of data, participation in the Resource-Sharing Ecosystem, or engagement as an SME, shall constitute deemed and binding acceptance of this T&C in its entirety by the User concerned. Where CBC additionally requires a signed acceptance, undertaking, or MoU from a TI, SME, or other User at any point, such requirement shall be in addition to, and shall not derogate from, the binding effect of this clause.

3.3

This T&C shall constitute a legally binding instrument between CBC and each TI/SME/User for so long as such use, registration, access, or engagement continues, and shall survive, to the extent of clauses expressly stated to survive (including confidentiality and intellectual property), the discontinuation of such use, registration, access, or engagement.

Registration and Eligibility

4.1 Training Institution (TI)

A TI seeking registration on the Portal shall furnish accurate and complete information across such data fields as CBC may prescribe on the Portal from time to time. No submission of supporting documentation shall be required for registration, save where CBC expressly prescribes otherwise for a specific data field or purpose.

4.2 Eligibility of a TI

Registration on the Portal shall be open to an institution or organisational entity that has a continuing and explicit mandate, under an applicable Government order, notification, statute, administrative arrangement, or other formal instrument, to provide training or capacity building to serving civil service or government officials. Such a mandate may extend to induction, foundational, in-service, mid-career, thematic, domain-specific, leadership, technical, or other forms of structured training, whether delivered through short-term, long-term, residential, non-residential, or blended programmes.

For the purposes of registration, an institution shall be considered a TI where:

  • it has a formal and continuing mandate to undertake training or capacity building of government officials; and
  • training of government officials forms a substantive and continuing function of the institution, whether as its primary mandate or as an established institutional function; and
  • the institution undertakes, or is established to undertake, structured training programmes on a recurring basis for government officials.

An institution shall not be eligible for registration merely by virtue of having, on an occasional or ad hoc basis, been requested or permitted to host, facilitate, or conduct a training programme for government officials, where it does not otherwise have an established mandate to undertake such training. Institutions established solely for research, academic research, consultancy, or other functions, without an explicit and continuing mandate to train government officials, shall similarly not be eligible for registration.

Institutions established in a mission-mode or event-specific manner for a particular temporary requirement shall not be eligible for registration on the UNNATI Portal.

4.3 Classification of Eligible TIs

An eligible TI shall, at the time of registration, identify the category that most appropriately corresponds to its institutional mandate and administrative structure. The categories below are intended to provide a common classification framework for eligible TIs:

Category of TI Definition
Central Training Institute (CTI) A training institution functioning under a Ministry/Department of the Government of India and mandated to provide training to officers of Organised Group A Services. CTIs generally undertake service-specific induction, in-service, mid-career, or other structured training for the officers of the respective service.
Administrative Training Institute (ATI) A State-level apex training institution responsible for capacity building of State Government officials. ATIs generally undertake induction training for State Civil Services, in-service and mid-career training, thematic governance programmes, and training relating to district and field administration, and function as the principal training arm of the respective State Government.
Central Domain Training Institute (CDTI) A training institution under a Central Government Ministry/Department or other eligible central government organisational framework, with a specialised mandate for training in a particular sector or thematic domain, including areas such as health, rural development, finance, digital governance, security, education, or environment.
State Domain Training Institute (SDTI) A State Government-owned or controlled specialised training institution with a continuing mandate to provide training to State Government officials within a specific sector or functional domain. Such institutions are sector- or domain-specific rather than generalist administrative training institutions.
Central Regional Training Institute (CRTI) A regional or field-level training institution established under the Central Government as a regional arm or extension of a CTI, CDTI, or other central training institution, with a defined regional jurisdiction or responsibility for delivering training to government officials across multiple States or locations.
State Regional Training Institute (SRTI) A regional or zonal training institution established under a State Government to decentralise the delivery of training to State Government officials across specified regions, districts, or clusters. Such institutions ordinarily operate under, or within the broader training architecture of, the concerned ATI or State Government training system.
Public Sector Undertaking Training Institute (PSU Training Institute) A training institution or academy established or operated by a Public Sector Undertaking or other Government-owned corporate entity, with a continuing institutional mandate to provide structured training to government officials or personnel of the concerned public sector organisation. Such training may include induction, technical skill development, managerial and leadership training, regulatory and compliance training, safety training, or operational training.

4.4 Subject Matter Expert (SME)

An SME seeking enrolment in the SME Pool shall furnish accurate and complete information across such data fields as CBC may prescribe, including professional profile inputs, such as curriculum vitae, LinkedIn or other professional profile links, and such other inputs as may reasonably establish the SME’s credibility, in the manner and form prescribed by CBC on the Portal, and subject to such eligibility criteria as CBC may prescribe for the Pool generally, or for a specific category of CBC Engagement, from time to time.

4.5 Eligibility of SME

An SME is selected based on a minimum of twenty (20) years of relevant professional experience, with at least five (5) years of specialised expertise in the concerned sector(s). For emerging domains, relevant experience will be assessed based on criteria as determined by CBC from time to time.

4.6 Integrity Obligation

It shall be the responsibility of every SME to ensure that they are not, at the time of enrolment or at any time thereafter, subject to any vigilance inquiry, disciplinary proceeding, pending criminal proceeding, or any other matter that would render them unsuitable to be enrolled or to act as an SME. Suppression of any material fact in this regard, or the furnishing of false or misleading information at enrolment or at any time thereafter, shall render the SME liable to action under Sections 7.6 and 11 of this T&C, without prejudice to any other action CBC may deem fit.

Roles and Responsibilities

5.1 CBC

CBC, as the nodal body administering UNNATI, shall:

  • operate, maintain, and administer the Portal for registration of TIs and enrolment of SMEs;
  • develop, maintain, upgrade, and evolve the technical infrastructure of the Portal, including the Resource-Sharing Ecosystem, the SME Pool, the Course Content Library, and such other features (including joint course creation functionality) as CBC may introduce from time to time, and shall use reasonable efforts to ensure their availability and functioning;
  • administer the SME Pool, including enrolment, such verification of profile information as CBC determines necessary, and visibility of SMEs to TIs on the Portal;
  • constitute and administer CBC Engagements as and when CBC determines necessary, including issuing the applicable Engagement-Specific ToR and organising relevant orientation for SMEs/TIs or any other User consenting to participate in a CBC Engagement;
  • be responsible for the security, integrity, and privacy of data held on the Portal, in accordance with the DPDP Act, including reasonable technical and organisational measures against unauthorised access, and maintenance of regular backups of Portal data;
  • provide technical support and a helpdesk mechanism to Users for resolution of Portal-related queries and technical difficulties;
  • publish, and update from time to time, user guidance to assist TIs and SMEs in the use of the Portal;
  • notify Users, wherever practicable and in advance, of scheduled maintenance, downtime, or material changes to Portal features;
  • retain overall oversight of TI participation in the Resource-Sharing Ecosystem and of SME enrolment on the Portal, and may call for clarification or information from any User at any time;
  • where warranted, report to the concerned parent MDO/State/UT/Department on a matter concerning a TI or SME under its administrative control, for such action as may be necessary;
  • administer the administrative action and grievance redressal mechanisms set out in Sections 11 and 12 of this T&C.

5.2 TI

A TI registered on the Portal shall:

  • ensure that all data submitted to the Portal, at registration and in every subsequent submission, is true, complete, and accurate to the best of its knowledge, and shall proactively update such data as and when institutional facts change; a submission found to be false, misleading, fabricated, or materially stale shall render the TI liable to action under Sections 10 and 11 of this T&C, without prejudice to any other consequence;
  • participate in the Resource-Sharing Ecosystem in accordance with Section 6 of this T&C, and keep the underlying data current;
  • comply with this T&C and with all policies published by CBC on the Portal, including in respect of any collaboration with an SME, or other User discovered or contacted through the Portal, which shall be governed by Sections 7 and 8 of this T&C.

5.3 SME

An SME enrolled in the SME Pool shall:

  • exist on the Portal as a discoverable expert who may be directly contacted and leveraged by a TI, on a consent basis; where the SME additionally consents to participate in a CBC Engagement, the SME shall attend such orientation as CBC may organise, and shall satisfy themselves of the applicable process and expected quality standards, before undertaking any visit to, or guiding, a TI under that CBC Engagement;
  • ensure that the information maintained on their Portal profile remains true, complete, and current;
  • disclose any conflict of interest arising in relation to any TI they are contacted by or engaged with, whether directly or through a CBC Engagement, and recuse themselves where such a conflict arises;
  • maintain confidentiality of all information and material accessed in the course of any such collaboration or engagement, an obligation which shall survive its conclusion.

5.4 Representations and Warranties in respect of Submitted Data and Content

Each TI, SME and User represents and warrants, at the time of registration or enrolment and each time it submits, uploads, shares, publishes, or otherwise makes available any data, information, document, material, or Portal Content through the Portal, that:

  • such data, information, document, material, or Portal Content is true, complete, and accurate to the best of its knowledge;
  • it is the owner of such material, where applicable, or otherwise has the lawful authority and all necessary rights, licences, permissions, approvals, and consents required to submit, upload, share, publish, or make such material available through the Portal;
  • such submission, upload, sharing, publication, or use does not infringe the intellectual property rights, confidentiality rights, privacy or data protection rights, contractual rights, or any other rights of any third party and does not violate any applicable law;
  • where any material is submitted on behalf of another person, institution, Government entity, or other third party, it is duly authorised to make such submission; and
  • it shall promptly notify CBC if any representation or warranty under this Section ceases to be true and shall take such corrective action, including correction, replacement, or withdrawal of the concerned material, as CBC may reasonably require.

CBC shall be entitled to rely on the representations and warranties under this Section and shall not be required to independently verify ownership, authority, or third-party rights in respect of material submitted by a TI or SME.

Resource-Sharing Ecosystem

6.1

Nature of the Portal’s Role: The Portal shall function solely as a connecting and discovery mechanism enabling TIs to identify and reach other TIs for the sharing of infrastructure, faculty, and course content. CBC and the Portal shall have no role in, and shall assume no responsibility for, the negotiation, pricing, invoicing, payment liability, or settlement of any consideration, monetary or otherwise, between TIs in respect of resources shared through the Portal. The Portal may host a payment gateway but would not arbitrate any payment settlement conflicts between the TIs.

6.2

Off-Portal Settlement: All arrangements arising from use of the Resource-Sharing Ecosystem, whether the sharing TI offers a resource free of charge or for compensation, including pricing, timelines, delivery, quality, and any dispute between the TIs concerned, shall be settled directly between the TIs concerned, and in accordance with applicable State or Central Government financial and procurement norms as independently applicable to the engaging TI. CBC shall bear no liability whatsoever in respect of any such arrangement or agreements by or between TIs, SMEs or any other User arising from the use of the Resource-Sharing Ecosystem enabled through the Portal.

6.3

No Warranty: CBC shall not verify, certify, or warrant the accuracy of any claim made by a TI regarding the availability, quality, or suitability of infrastructure, faculty, or content offered through the Resource-Sharing Ecosystem. Reliance on any such claim shall be at the sole risk of the TI or User availing it.

6.4 Course Content Library — Ownership and Licence

  • Portal Content uploaded by a TI to the Course Content Library shall, at all times, vest solely and exclusively in the TI that created it. No other TI, SME, User, or CBC shall acquire any ownership interest in such Portal Content by virtue of its being shared, accessed, or used through the Portal.
  • The originating TI, by sharing Portal Content through the Course Content Library, shall be deemed to grant CBC and other TIs accessing the Library a non-exclusive, royalty-free licence to use and display such Portal Content for training-delivery purposes within the Portal, without affecting the originating TI’s ownership under Section 6.4(a) of this T&C.
  • The originating TI alone shall have the right to determine whether, and on what terms, its Portal Content may be adapted, modified, or built upon by another TI, and whether any resulting adaptation or modification may be attributed to, or represented as the work of, the TI that undertook it. Absent the prior written consent of the originating TI, no TI accessing Portal Content through the Library shall modify, adapt, or represent such Portal Content, or any part thereof, as its own.
  • A modification, adaptation, or claim of ownership over another TI’s Portal Content, made without the prior written consent of the originating TI, shall constitute a Prohibited Activity under Section 10 of this T&C. Redress in respect of such a claim shall be a matter for the originating TI to pursue directly against the TI concerned, without prejudice to any administrative action CBC may separately take under Section 11 of this T&C.

6.5 Restriction on Onward Sharing

Portal Content, and any other resource, data, or material accessed through the Resource-Sharing Ecosystem, shall be used within the Portal ecosystem alone. It shall not be reproduced, shared, or provided to any third party, meaning any person or entity not registered and verified on the Portal, without the prior written permission of the originating TI. CBC shall bear no responsibility for any such unauthorised onward sharing, and any such act shall constitute a Prohibited Activity under Section 10 of this T&C.

SME Onboarding and Participation on the Portal

7.1

Nature of the SME Pool: An SME enrolled in the SME Pool shall be made discoverable to TIs on the Portal. A TI may directly contact and collaborate with an SME found through the Portal. Any such collaboration, and every term thereof, including scope, compensation, and deliverables, shall be settled directly and independently between the TI and the SME, outside the Portal, save where the collaboration forms part of a CBC Engagement in accordance with Section 7.3 of this T&C.

7.2

Enrolment Obligation: An SME shall, at the time of enrolment and on a continuing basis thereafter, furnish accurate information and such credibility inputs (including curriculum vitae, LinkedIn or other professional profile links, and related material) as CBC may prescribe. Furnishing false, misleading, or fabricated information at enrolment, or at any time thereafter, shall constitute a Prohibited Activity under Section 10 of this T&C.

7.3 CBC Engagements

Where CBC formally constitutes a CBC Engagement, an SME’s participation therein shall be voluntary and subject to the SME’s prior consent. An SME consenting to participate in a CBC Engagement shall:

  • attend such orientation as CBC may organise, and satisfy themselves as to the applicable process and expected quality standards, before undertaking any visit to, or guiding, a TI under that CBC Engagement;
  • discharge the responsibilities assigned to them in accordance with the applicable Engagement-Specific ToR;
  • disclose any conflict of interest arising in relation to that CBC Engagement, and recuse themselves where such a conflict arises;
  • maintain confidentiality of all information and material accessed in the course of that CBC Engagement, an obligation which shall survive its conclusion.
7.4

Nature of Engagement: No collaboration under Section 7.1, and no CBC Engagement under Section 7.3 of this T&C, shall constitute a contract of employment. Neither shall create an employer-employee relationship between the SME and CBC or the TI concerned, and neither shall confer on the SME any right to claim regularisation, absorption, or permanent employment with CBC, the TI, or the Central or State Government.

7.5

Compensation: Any compensation, honorarium, or payment arising from a direct TI-SME collaboration under Section 7.1 shall be settled entirely between the TI and the SME, outside the Portal, and shall not involve or be routed through CBC. Where CBC constitutes a CBC Engagement, the terms of any honorarium or reimbursement payable by CBC to a participating SME shall be as set out in the applicable Engagement-Specific ToR.

7.6

Discontinuation and Removal from the SME Pool: CBC may remove an SME from the SME Pool, or restrict their visibility or access on the Portal, where the SME has furnished false or misleading information at enrolment or thereafter, breached confidentiality, failed to disclose a conflict of interest, or otherwise breached this T&C or an Engagement-Specific ToR, in accordance with the procedure under Section 11 of this T&C.

7.7

SME Terms of Reference: In addition to the terms set out in this T&C, all aspects of CBC or TI engagement in relation to the Portal, for the objective set out under Section 1.2 of this T&C, shall be governed by the Engagement-Specific ToR as issued by CBC. In case of any conflict between the provisions of this T&C and the Engagement-Specific ToR, the latter shall prevail, with respect to all engagements concerning an SME.

Data, Ownership, and Confidentiality of TI–SME and External Collaborations

8.1

Any collaboration, partnership, or arrangement between a TI and an SME, or between a TI and any other industry expert, discovered or initiated through the Portal shall be a matter between those parties alone.

8.2

Ownership of data and work product, and confidentiality obligations, arising from any such collaboration shall be governed entirely by the Memorandum of Understanding, agreement, or other instrument that the parties concerned enter into between themselves. CBC shall have no role in, and shall assume no responsibility for, determining or enforcing such ownership or confidentiality terms, save where the collaboration forms part of a CBC Engagement governed by an Engagement-Specific ToR.

8.3

This Section shall not affect CBC’s responsibility, under Section 5.1(e) of this T&C, for the security, integrity, and privacy of data held on the Portal itself, as distinct from any arrangement the parties conclude outside the Portal.

Intellectual Property

9.1

Unilaterally Shared Content: Portal Content shared unilaterally by a TI through the Course Content Library shall be governed by Sections 6.4 and 6.5 of this T&C.

9.2

Joint Course Creation: The Portal may enable TIs, or a TI and an SME, to jointly create, upload, or curate Portal Content. Ownership, sharing rights, and disclosure in respect of any such jointly created Portal Content shall be as mutually agreed and consented to by the contributing parties between themselves. CBC shall neither be liable nor have any role in determining, adjudicating, or enforcing any such ownership or sharing arrangement.

9.3

Unresolved Ownership: Portal Content in respect of which ownership, contribution, or sharing rights remain unresolved, or are under discussion between the contributing parties, shall not be uploaded to the Portal. Upload of any jointly created Portal Content shall be treated as a representation by the contributing parties that ownership and sharing terms between them stand finalised and mutually consented to for the purpose of its use through the Portal. Claims, if any, arising from such unresolved ownership shall be limited to the parties inter se, and CBC shall not have any liability.

9.4

CBC Engagement Content: Content created or updated by an SME under a CBC Engagement shall vest as set out in the applicable Engagement-Specific ToR. In the absence of such provision, it shall vest in the entity on whose behalf it was developed, and the SME shall not use, reproduce, or claim ownership over it for any purpose outside that CBC Engagement, without the prior written consent of that entity.

Prohibited Activities

The following, without limitation, shall constitute Prohibited Activities under this T&C, whether committed by a TI, SME, or other User:

  • submitting false, misleading, fabricated, placeholder, or materially stale data or information to the Portal, whether at registration/enrolment or thereafter;
  • reproducing, sharing, or providing Portal Content or any other Resource-Sharing Ecosystem material to any third party not registered and verified on the Portal, without the prior written permission of the originating TI;
  • misrepresenting infrastructure, faculty availability, or the CBP-alignment of any course or resource offered through the Portal;
  • breach of any confidentiality obligation under Sections 5.3(d), 7.3(d), or 8 of this T&C;
  • unauthorised access to, or misuse of, another User’s Portal credentials or account;
  • uploading jointly created Portal Content in breach of Section 9.3 of this T&C; or modifying, adapting, or representing another TI’s Portal Content, in whole or in part, as its own, without the prior written consent of the originating TI, contrary to Section 6.4(c) of this T&C;
  • conduct amounting to harassment, coercion, or misconduct towards CBC personnel, an SME, or a TI representative in the course of any Portal-related interaction;
  • representing, implying, or holding out that CBC or the Portal is a party to, endorses, or guarantees any off-Portal arrangement between a TI and another TI, or between a TI and an SME, contrary to Sections 6.1 or 8.2 of this T&C;
  • breach of any intellectual property provision under Section 9 of this T&C;
  • failure to disclose a conflict of interest under Section 5.3(c) or 7.3(c) of this T&C;
  • any other material breach of this T&C, or persistent non-response to communications from CBC in relation to the Portal.
This list is illustrative and not exhaustive; CBC may treat any other conduct inconsistent with the objectives of this T&C as a Prohibited Activity.

Administrative Action

11.1

Nature of Consequences: As no payment or settlement mechanism currently exists on the Portal, no monetary penalty, forfeiture, or damages shall be imposed under this T&C, except as set out under Section 14 of this T&C. Consequences for a Prohibited Activity shall be administrative in nature and limited to matters within CBC’s control in respect of the Portal and CBC Engagements, as set out below.

11.2 Actions Available Against a TI

As TI registration on the Portal forms part of a Government of India initiative and shall not be revoked or withdrawn (see Section 13.1 of this T&C), the actions available to CBC against a TI shall be limited to:

  • issuing an advisory or warning notice;
  • flagging the TI’s Portal profile;
  • restricting the TI’s access to a specific Portal feature (including the Resource-Sharing Ecosystem or the SME Pool);
  • suspending the TI’s access to a specific Portal feature for a specified period;
  • reporting the matter to the parent MDO/State/UT/Department of the TI concerned.
11.3

Actions Available Against an SME: CBC may, in addition to the actions available under Sections 11.2(c) to (e) of this T&C, remove an SME from the SME Pool, or exclude the SME from participation in CBC Engagements for a specified period.

11.4

Procedure: Before taking action under Sections 11.2(c) to (e) or Section 11.3 of this T&C, CBC shall issue notice to the TI/SME concerned, setting out the grounds, and afford a reasonable opportunity (ordinarily not less than fifteen (15) days) to respond, before a final decision is taken, except where CBC considers that the integrity of the Portal or of Portal data is at immediate risk, in which case an interim restriction may be imposed with immediate effect, subject to a post-facto opportunity to respond.

11.5

Appeal: A TI or SME aggrieved by an action under this Section may appeal to the Competent Authority designated by CBC, within fifteen (15) days of the action. The action under appeal shall continue to have effect pending disposal of the appeal, unless the Competent Authority directs otherwise. The decision of the Competent Authority on appeal shall be final and binding.

12

Grievance Redressal

12.1 Scope

A grievance may be raised under this Section by a TI, SME, or other User in respect of:

  • difficulty, delay, or error in registration or enrolment on the Portal;
  • technical malfunction, error, or non-availability of the Portal or a Portal feature;
  • an act or omission of CBC in the discharge of its role under this T&C;
  • an alleged breach of this T&C by another User, insofar as it concerns the functioning of, or conduct on, the Portal.
A grievance concerning a matter falling outside the scope of this T&C, including a matter under Section 6.2 or Section 8 of this T&C, is to be settled between the parties themselves.
12.2

Mechanism: A grievance shall, in the first instance, be raised with the nodal officer designated by CBC for this purpose, as published under the Contact Us section of the Portal. If unresolved, it may be escalated to the Competent Authority within CBC, whose decision shall be final and binding on the parties.

12.3

Nothing in this Section shall restrict, exclude, or prejudice any remedy, appellate mechanism, right, or recourse available to any person under applicable law.

12.4

This Section shall not extend to, and CBC shall not be party to, any dispute concerning a matter settled outside the Portal, including any consideration between TIs for shared resources under Section 6 of this T&C, or any compensation arising from a direct TI-SME collaboration under Section 7.1 of this T&C. Any such dispute shall be resolved by the parties concerned through their own applicable administrative or contractual mechanisms.

Continuity of Registration

13.1

TI: Registration and participation of a TI on the Portal, being part of a Government of India initiative, shall not be terminated, withdrawn, or revoked, whether at the instance of the TI or otherwise, save for the administrative restrictions available to CBC under Section 11.2 of this T&C. A TI’s registration on the Portal shall continue for so long as it functions as a Training Institution within the applicable Government framework.

13.2

SME: Removal of an SME from the SME Pool shall be governed by Sections 7.6 and 11.3 of this T&C.

Liability and Disclaimer

14.1

CBC and the Portal shall function solely as a facilitative and connecting mechanism between CBC, TIs, and SMEs. CBC shall not be liable for the accuracy of data submitted by a TI or SME, for any arrangement settled off-Portal under Section 6 or Section 8 of this T&C, or for the outcome of any collaboration or CBC Engagement beyond CBC’s own role in facilitating or constituting it.

14.2

CBC shall not be liable for any interruption, delay, or downtime of the Portal, or for any consequential loss arising therefrom.

14.3

Nothing in this T&C shall create any liability of CBC, being a Government of India body, beyond what is permissible in law, and this T&C shall be read subject to applicable Government of India rules and orders governing the liability of Government instrumentalities.

14.4 Indemnity

Each TI and SME shall indemnify and keep indemnified CBC, its Members, officers, employees, and authorised representatives from and against any third-party claim, demand, action, proceeding, liability, loss, damage, cost, or reasonable legal expense arising out of or relating to:

  • any data, information, document, material, or Portal Content submitted, uploaded, shared, published, or otherwise made available by that TI or SME which infringes or is alleged to infringe the intellectual property, confidentiality, privacy, data protection, proprietary, contractual, or other rights of a third party;
  • any breach by that TI or SME of the representations and warranties under Section 5.4 of this T&C;
  • any unlawful, unauthorised, fraudulent, or misleading submission or use of material by that TI or SME through the Portal; or
  • any act or omission of that TI or SME in connection with an off-Portal arrangement or CBC Engagement, to the extent that such claim arises from an act or omission attributable to that TI or SME.

CBC shall, where reasonably practicable, notify the concerned TI or SME of any third-party claim for which indemnity is sought and the TI or SME shall provide such reasonable cooperation as CBC may require in relation to the defence or resolution of the claim.

The indemnity under this Section shall not apply to the extent that the claim arises solely from an independent act or omission of CBC unrelated to the material or conduct of the concerned TI or SME.

The obligations under this Section shall survive discontinuation of registration, enrolment, Portal access, or the relevant CBC Engagement.

14.5

Force Majeure: CBC shall not be liable for any delay, interruption, suspension, loss of availability, or failure in the operation or functioning of the Portal arising from an event beyond its reasonable control, including any natural disaster, fire, flood, epidemic or pandemic, war, civil disturbance, act or restriction of Government, failure or disruption of electricity, telecommunications, internet connectivity, cloud infrastructure or data-centre services, malicious cyberattack, distributed denial-of-service attack, ransomware or other cybersecurity incident, or comparable technical or infrastructure failure beyond CBC’s reasonable control.

During the continuance of such an event, CBC may suspend or restrict any Portal functionality to the extent reasonably necessary to protect the Portal, its Users, or Portal data, and shall use reasonable efforts to restore affected services when reasonably practicable.

Miscellaneous

15.1

Amendment: CBC may amend this T&C at any time. An amendment shall take effect upon publication on the Portal, and continued access to or use of the Portal thereafter shall constitute acceptance of the amended T&C.

15.2

Severability: If any provision of this T&C becomes unenforceable due to a change in applicable law, the remaining provisions shall continue in full force and effect so as to give effect to the intent of the parties.

15.3

Assignment: The rights and obligations of a TI or SME under this T&C shall be personal to that TI or SME and shall not be transferable or assignable without the prior written consent of CBC.

15.4

Notices: Notices and communications under this T&C shall be made through the Portal, or through such other official mode of communication as CBC may specify.

15.5

Governing Framework: This T&C shall be read and given effect subject to applicable Government of India rules, orders, and guidelines governing CBC and its instrumentalities, as amended or superseded from time to time.

15.6

Effective Date: This T&C shall take effect from the date of its notification/publication on the Portal.
